GENERAL TERMS AND CONDITIONS
\nfor trading in precious metals of Edisontrade d.o.o.<\/p><\/h4><\/div>

1. General provisions<\/strong><\/p>\n

These General Terms and Conditions (hereinafter: the General Terms) govern the relationship between Edisontrade d.o.o. (hereinafter: the Provider) and customers or users of the Provider\u2019s website (hereinafter: the Customer).<\/p>\n

The General Terms are available to customers at all times:<\/p>\n

in written form at the business premises of Edisontrade d.o.o., and<\/p>\n

24 hours a day on the official website of the company at www.edisongold.com.<\/p>\n

The General Terms valid at the moment when Edisontrade d.o.o. accepted the Customer\u2019s order shall apply.<\/p>\n

3. Scope of application<\/strong><\/p>\n

These General Terms apply to:<\/p>\n

the sale of investment gold and other precious metals (investment gold, silver, platinum, palladium),<\/p>\n

the purchase of precious metals,<\/p>\n

online orders,<\/p>\n

payments, delivery and collection of goods.<\/p>\n

For matters not expressly regulated by these General Terms, the laws of the Republic of Slovenia and the European Union shall apply, in particular the Code of Obligations, the Consumer Protection Act (ZVPot-1), the Personal Data Protection Act (ZVOP-2), the General Data Protection Regulation (GDPR), and other applicable legislation.<\/p>\n

4. Placing an order<\/strong><\/p>\n

For reasons of transparency, verifiability and traceability, the Customer may place an order for the purchase or sale of precious metals exclusively in written form, as follows:<\/p>\n

in person at the Edisongold Koper branch, Ankaranska cesta 7b, 6000 Koper (by signing the order),<\/p>\n

in person at the Edisongold Ljubljana branch, Savska cesta 9, 1000 Ljubljana (by signing the order),<\/p>\n

via e-mail,<\/p>\n

via a secure online connection (online orders) on the official website of Edisontrade \u2013 www.edisongold.com, during business hours.<\/p>\n

By placing an order, the Customer confirms that they are familiar with the General Terms, understand them, and fully agree to them.<\/p>\n

5. Conclusion of the sales contract<\/strong><\/p>\n

5.1<\/p>\n

The sales contract shall be deemed concluded at the moment when Edisontrade d.o.o. confirms the Customer\u2019s order by issuing a pro forma invoice based on the online order, during business hours of the branch:<\/p>\n

Monday \u2013 Thursday: 09:00 \u2013 17:00<\/p>\n

Friday: 09:00 \u2013 13:00<\/p>\n

5.2<\/p>\n

The agreed price shall be the price valid at the moment of acceptance of the order by Edisontrade d.o.o.<\/p>\n

The Customer acknowledges that the price may change between the placement of the order and its confirmation due to fluctuations on the precious metals market.<\/p>\n

5.3<\/p>\n

After accepting the order, Edisontrade d.o.o. shall immediately lock in the price and place the order with the supplier or refinery.<\/p>\n

5.4<\/p>\n

The Customer expressly acknowledges that precious metal prices are directly linked to financial markets over which Edisontrade d.o.o. has no control. In the case of distance contracts, the Customer shall not have the right to withdraw from the contract after the order has been accepted, in accordance with the Consumer Protection Act (ZVPot-1).<\/p>\n

5.5<\/p>\n

In the event of unjustified withdrawal from the order, provision of false information, or failure to fulfil obligations on the part of the Customer, the Customer shall be obliged to pay Edisontrade d.o.o. a contractual penalty amounting to 10% of the order value, unless otherwise provided by law.<\/p>\n

6. Purchases via the online store<\/strong><\/p>\n

6.1<\/p>\n

All orders placed through the website (www.edisongold.com) of Edisontrade d.o.o. shall be subject to these General Terms unless explicitly stated otherwise for a specific case.<\/p>\n

6.2<\/p>\n

Before confirming the order, the Customer must confirm acceptance of the General Terms. The price valid at the time of order confirmation shall apply.<\/p>\n

6.3<\/p>\n

Until the order is confirmed, the Customer may freely add or remove products from the shopping cart.<\/p>\n

6.4<\/p>\n

By confirming the order, the contract between the Customer and Edisontrade d.o.o. shall be deemed concluded, and the Customer is considered to have accepted these General Terms.<\/p>\n

7. LBMA FIXING \u2013 special trading regime<\/strong><\/p>\n

7.1<\/p>\n

In the event of extraordinary market conditions in the precious metals market, Edisontrade d.o.o. may introduce a special trading regime under which purchases are possible exclusively via the LBMA fixing (AM and PM).<\/p>\n

7.2<\/p>\n

In such cases, the Customer must submit a binding order no later than:<\/p>\n

10:00 for the AM fixing,<\/p>\n

14:30 for the PM fixing.<\/p>\n

7.3<\/p>\n

The final price of the ordered goods shall be determined:<\/p>\n

at 11:30 (AM fixing),<\/p>\n

at 16:00 (PM fixing).<\/p>\n

7.4<\/p>\n

Once the price has been determined through the LBMA fixing, the order may no longer be cancelled or modified, and the Customer expressly acknowledges and agrees to this.<\/p>\n

8. Delivery and availability of goods<\/strong><\/p>\n

If the ordered goods are not in stock, the estimated delivery time shall be approximately one (1) month, depending on the supplier and market conditions in the precious metals market.<\/p>\n

The Customer shall be informed subsequently about stock availability and the collection date.<\/p>\n

9. Transport and collection<\/strong><\/p>\n

The costs of insured transport and insurance to the business premises of Edisontrade d.o.o. are included in the price unless otherwise agreed in writing.<\/p>\n

The goods may be collected at the business premises of Edisontrade d.o.o. or, by agreement, delivered via insured shipment by Po\u0161ta Slovenije to the address provided by the Customer when placing the order.<\/p>\n

10. Payment<\/strong><\/p>\n

The Customer is obliged to pay the full purchase price on the same day as receipt of the pro forma invoice, unless otherwise agreed in writing.<\/p>\n

Available payment methods:<\/p>\n

bank transfer,<\/p>\n

cash payment (where permitted by law).<\/p>\n

In the event of late payment, the Provider reserves the right to withdraw from the contract or to charge the contractual penalty specified in clause 5.5 of these General Terms.<\/p>\n

11. Complaints and claims<\/strong><\/p>\n

The Customer may submit complaints in writing to the Provider\u2019s e-mail address. The Provider shall process the complaint as soon as possible.<\/p>\n

12. Personal data protection<\/strong><\/p>\n

The Provider processes personal data in accordance with the GDPR and applicable legislation. Details are specified in the Privacy Policy published on the Provider\u2019s website.<\/p>\n

13. Dispute resolution<\/strong><\/p>\n

All disputes shall be governed by the laws of the Republic of Slovenia. The competent court in the Republic of Slovenia shall have jurisdiction.<\/p>\n

15. Final provisions<\/strong><\/p>\n

The Provider reserves the right to amend these General Terms.
